probably a dumb question but I really have no idea

if you only do eats/delivery do you have to do that gst/abn shit from the first dollar turn over?

doesnt seem right since I dont think ridesharing a pizza counts as ridesharing lol

The $1 threshold for providing 'taxi services' as defined in the GST legislation applies only if you transport passengers. So if you transport only food via UberEats, you need pay GST only if your annual turnover is at least $75,000.

Note, however, if you conduct an enterprise that requires you to pay GST, you need to pay it for all your enterprises including those that would otherwise be exempt by being under the $75,000 threshold.

ABN required, no GST registration necessary provided you haven't taken a paying customer either now or in the future. I was reading if you do Eats only, the commission to Uber is higher.
ABN required? when I signed up for eats at the greenlight hub I wasnt asked for one.

Also while I was at the hub they werent able to help with this question said tax is my responsibility and they could shed no light on the issue lol

You will need an ABN for uber eats. If you use the same ABN for UberX that ABN will be registered for GST and you will be expected to pay GST on the Uber eats as well.
If you are just doing Uber Eats and you have a ABN which is not GST registered you can use it as Uber Eats does not require a Taxi / Hire Car Authorisation.
I have 2x ABNs. A personal one under my name which I use for all non GST business activities and a partnership ABN which is GST registered which I use for UberX. I have no intention of doing UberEats, but if I did I would use my non GST ABN under a different Uber signup to keep the UberX & UberEats income separate.
This is only my advice. Dont take it as the law.

ALSO Uber has no interest in your ABN. The ATO does.

Hi mate,

I am quite confused about Tax issue.
I have a full time job ( over 75K income ) and I do ubereats as a hobby ( on the way to work ). My questions
1) I already got ABN number as sole trader. Should I register for GST ? I do not do contractor work in my main job
2) If yes, then should I pay extra gst on my main income as well?
3) what sort of things my I claim deductions with ABN ?

1st question is the tricky one I am already paying GST for my main job, I do not want to be charged additional tax.

ABN withholding is reported and withheld by businesses paying its suppliers. Uber is the business, you are the supplier. Uber is realistically falling afoul of the withholding law.

The ATO cannot withhold money, as they don't pay you money.

I didn't get an ABN until December and I drove for UberX in February 2015 and also from September 2016 onwards, doing eats only. I have never quoted my ABN to Uber. I only got the ABN because I picked up another job driving a doctor for after hours GP appointments, and I'd rather not have them withhold 49%!

Thanks for your response AussiePaul. I recognise that an ABN is required. I am asking about the classification/category that should be used when registering for an ABN. i.e., UberX drivers are required to classify their business activities as taxi/limo services. UberEATS drivers are not providing a Taxi/Limo service, so my question is what should be used instead?

I just don't see a point in having the ABN, unless you are making documentation i.e. Invoicing.
In the case of contracting, the entity contracting you to perform the services is required to withhold 49% of all monies owed to you and submit it to the ATO, if you don't supply them (Uber in this case) with your ABN. If Uber ever decided to (or were forced to) play straight with the ATO, you wouldn't see that 49% till after your tax return - defeats the purpose of working for immediate payment.
But we all know about Uber's attitude to any form of compliance.
My dealings with the ATO suggest that playing by their rules is the way to go.
That way they don't come looking and demanding. ABN supplied to Uber = clean sheet for you.

It definitely seems that you wouldn't really need an ABN to do UberEATS then. It's only for disclosure to businesses that will require it or else withhold 49%.

I doubt any of the hordes of backpackers getting around on crappy 50cc scooters, random bicycles or $500 bombs have ABNs to be honest.

I can't wait to receive a letter with something to the effect of "hey you haven't registered for GST but there's Uber's in your bank every week, plz explain"

It's a bit different for someone who does it for 1 month and then stops or a backpacker who does it for 3 months and then stops.
If you have the intention on doing UberEats ongoing the ATO would expect you to have an ABN.

You must register for GST if:
  • your business has a GST turnover of $75,000 or more
  • your non-profit organisation has a turnover of $150,000 per year or more
  • you provide taxi travel for passengers in exchange for a fare as part of your business, regardless of your GST turnover. This rule applies to both taxi owner drivers and people who just rent a taxi.

How are they crooks?

You always get paid more than $5 a delivery and that's all they charge customers. How the hell would that be sustainable? Exactly, it wouldn't be.

They take 30% of the restaurant because they have relieved them of the requirement to have delivery drivers, AND provided a super simple method for customers to order the food..

ALSO... some restaurants such as Brooklyn Depot charge WAY MORE if you order via UberEATS. Their burgers are a good $4 a piece more than if you eat in. won't catch me ordering them via Eats any time soon. It's cheaper for me to travel the Go Between Bridge return to go pickup from there than to pay extra for delivery and extra because it's Uber!
