RESTRICTIONS ON PERSONS IN VEHICLES

NRS 484B.130 or 484B.135.

1. It is unlawful for a person to drink an alcoholic beverage while the person is driving or in actual physical control of a motor vehicle upon a highway.

2. Except as otherwise provided in this subsection, it is unlawful for a person to have an open container of an alcoholic beverage within the passenger area of a motor vehicle while the motor vehicle is upon a highway. This subsection does not apply to:

(a) The passenger area of a motor vehicle which is designed, maintained or used primarily for the transportation of persons for compensation;

They can have their booze!

So what is your point? That has been the statute. Did you just now figure it out?

It doesn't say they can have their booze. In a private vehicle it's illegal.

I had a conversation with a Highway patrol officer a few months back and ask him about the passengers drinking and he said it was unlawful.

Why would anyone want to allow PAX in the car with open booze containers? This is Ride Share not a limo service! It is my personal car. I would not let friends or guests in the car that way. I'm certainly not going to allow a strangers for the $3.75 ride.
In fairness- Never said I agreed with allowing it.

Just clarifying that this clearly defines it as being a legal thing to allow

On the other hand, depending on the color of your interior and how susceptible it is to stains.. allowing alcohol seems like a heck of a way to farm some easy cleaning fees.
