Anyone here ever get laid off from work and then successfully collect unemployment income while driving for Uber/Lyft?


It seems unfair that independent contractors such as drivers don't and won't qualify for unemployment income if they get deactivated; but the CA EDD would want to know all your Uber and Lyft income in the event that you do file a claim for losing your job.


Anyone know if this is a bluff from the EDD so they can minimize the amount they pay to you or if this is something they really want to know about?

I guess I'm just trying to see if anyone successfully didn't report their Uber/Lyft income to the EDD and didn't get a call back from them..

They will catch you eventually, everythong is linked through computers theses days.

When they catch you they will stop your unenployment insurance and then the next time you need it you will have to wait the number of weeks it takes to deduct what they paid you plus penalties.

I think the better question is..... if Uber deactivates you, can you collect unemployment ?
No because we are 1099 not paying into EDD.

I believe Malibu Joe is referring to a layoff from a w2 real job, not from TNC.

I think it's ok cause it's a genuine lay off and we are not employees on TNC.

So I'm entitled to unemployment. But the question is - has anyone successfully claimed unemployment and still drove UBER
Some1 on here said he was doing it. It's perfectly legal to be receiving unemployment while working part time as long as you dont make more than the unemployment amount ur getting. They will reduce ur benefit though.

When you only make 1.50 per hour after expenses driving uber they won't reduce benefits much. Check into food stamps and Obama care also I qualify for both since uber pays me so little.

I had the same question... Basically it appears as thou you will receive a 1099 and that is what is sent to the IRS... You as no payments to the govt etc are made by uber however uber will have your work history... As long as the dates you recieve unemployment benefits do not overlap with when you claim to have been employed by uber you could probably fly under the radar... However if you used to a receive a high salary... You might want to think big picture and take the time to look at all the tax deductions... Depreciation... Etc you will be able to use being a driver and my guess is that you will be much better of if you can afford to not requesting unemployment... The other option is to only claim the min amount to still f
Get full ue... Take advantage of some re education opportunities maybe get certifications in old areas or new areas... Im getting 275$ a week in unemployment and i started driving for lyft on a saturday and claimed the $17 i made for my first time out only working a few hours when i submitted my weekly certification... And i caused a bug in their system here in TN.. My UEpayment was held up causing me to be late paying my rent... I logged a ticket with the online chat... I called and and had to have another ticket created due to systems not speaking to obe another and finally 4 days later because they had no one to work a low priority ticket the lady pushed it through cuz she felt bad for me because I was trying to do the right thing... And I did the right thing cuz my luck id get caught trying to hide income and get in trouble for fraud i was too scared... So good luck.... : )

See. This is where government should force a living earnings on ride share.

Yes. You report your Uber earnings. EDD will deduct your earnings after expenses, but the first $25 don't count. If you make over $100, EDD will deduct 75% of your earnings from your EDD weekly check.

How drivers are classified

Drivers and riders are users of the platform and aren't employees of the company. As members of the community platform, drivers and riders aren't entitled to benefits, worker's compensation, or unemployment insurance.

You are not an employee of FUber. You're a 1099 independent contractor. You cannot collect unemployment in that case.
That is up to the courts to decide. NYC judge recently ruled that we are employees. I intend to use the exact same argument in Virginia when I sue them for minimum wage and overtime. Just because Uber has incorrectly classified us as subs doesn't really mean a whole lot.

Lots of incorrect information on this thread. "Rideshare " drivers can file for unemployment benefits based on being misclassified employees and making less than minimum wage (after expenses).
No. If you don't have w2 wages, you have no claim basis for unemployment. There is no "misclassified employee" exception.
