I hadn't realized that part of the settlement agreement called for the judge to vacate his order allowing Uber drivers to sue in a class action rather than individually go to arbitration.

That's not going to happen.

Thus, it would appear that the settlement agreement will fall through. And was likely doomed from the beginning.

Well it should go to trial. More leverage for drivers when there's a threat of Uber losing and being forced by the court to make us employees. I think the general opinion is that Ubers current practices exert employer type controls on drivers so hands off drivers uber or employ us. Uber winning but being forced into an arms length relationship with ICs would be the best outcome possible for drivers. Throw a bone in for regulating background checks and complaints against drivers. so that there is oversight in the deactivation process and then Uber on!

ICs must have a independent regulatory agency which oversees pax and driver complaints and deactivation.

You can't have the wolf watching the sheep. I would imagine things wouldn't change that much except we'd get to see what the limits are to cancels or whatever instead of it being a secret and due to change at anytime depending on that markets averages.

Driver PARTNERS SHOULD have representation and a voice with the " board".

So many decisions made that affect us without any driver input or insight.

In order to properly manage Uber we should have a Voice.

Define PARTNERSHIP PARTNERS.

Partnership is NOT what we have.

If Uber were wise they would take steps to correct this.

It would be in the best interests of everyone.

The board can not consider what it never heard or sees.

Drivers make this company.

Our perspective MUST be recognized.

I honestly don't give a shit if only 1 driver goes to a jury trial. If he/she wins then all drivers going forward would be employees. I would just quit and come back the next day as an employee. Eff Uber, if they wanna play hard ball, let em. We will win.

I just want to make it clear, I'd rather be an independent contractor but this isn't about that, this is about making a stand against Uber and their wanting to have their cake and eat it too. They either need to call us employees and pay our expenses and reimbursements as such or call us independent contractors and treat us as such, by letting us pick and choose which requests to take etc etc. and not be able to treat us as employees.

If the judge caves in then we will all lose out. We need a trial. Period. End of story.
