Chen isn't doing that (and couldn't do that). Chen's has already ruled the case will be heard and decided in his court. All he said was that, having accepted the case (refusing to dismiss it) it doesn't matter much what verdicts are reached in his court because however it is decided by the jury, the verdict will appealed to a higher court... that is out of his control.
