Excellent article, and they Say Australia is the lucky country, what a sham!

We are going back to the master servant days. In the modern world we are adopting the slave style relationship so that the worker gets very little with no entitlements. The sad part is that the government ( both sides) is part of this new movement and are doing nothing to stop it. Look at uber for example, they are legislating to allow them to operate in the same manner. Sham, sham Shame!!!!

We have Government bodies in place whos job is to quickly identify the culprits, take them to court and fine them heavily. They are not doing thier job or simply too slow to respond. Meanwhile the trend continues to spread.

Uber are a perfect example!

Sham contracting is a clear and present danger to the great Australian way of life in my opinion.

the first round of uber drivers were happy to undercut the prices of the taxis.
Uber reduced the rates and there was another crop of new uber drivers reay to drive for the new lower rates, then the rates were cut again.

Choosing to be a contract driver means that you dont get the rates or protection of an award. The govt had for many years set the fares for the cabs so drivers could make reasonable money. Uber drivers chose to forfeit those conditions by accepting the conditions that uber offers.

You guys are going on about a minimum rate. should someone who signs on at 1.00am on a tuesday morning for 3 hours and only gets 3 pings be paid the same as a driver who logs on at peak time. How can you possibly work out a minimum wage rate when there are so many factors such as kms traveled per hour

If you choose to do o job on a commission basis are you entitled to minimum wage?
All subject to uber being an employer and offering a JOB.
there is no JOB ( with appropriate juristic conditions) ...being offered by uber.
Just a set of in-house rules for a game with money involved... That conduits through them....

Min wage, should not even be raised for this particular issue... Its not a JOB.

Higher rates in this game ... Is what we're after... OR...better reward for playing the game well..
OR... just continue gaming the game.

The pie's not big enough for 20000 SUCCESSFUL drivers, in Melbourne.
Not everyone will kick a goal.

Yes. Especially when the job is offerd under a "sham contracting" arrangement, masquerading as a "commision" job. In such cases not only the worker is striped off his entitlements, the worker is simply being exploited and underpaid.

Could the pizza hut drivers choose the hours they worked? Could they refuse to do a delivery?

Yep, they could choose the hours, being sham contractors. Within their 'on' hours they were supposed to do every delivery that comes to them. Much like Uber drivers who are not supposed to pick and choose but accept every fare and not ask questions.

At lest this is what Uber tells complaining customers.

That's what Uber tells *drivers* when they complain. When a customer comes to Uber saying they were contacted by driver, asked for destination and then cancelled, Uber muppet always stick by 'this is not OK'.

In reality, Uber drivers can't make an informed decision to refuse or accept based on a simple fact that they are not told where they are going. And this is not something Uber is prepared to change, they don't want us to pick where we want to go, which disqualifies the arrangement as 'independent contract' IMO.

Taxi drivers which uber drivers are, are a little different than pizza delivery guys. uber drivers can sit at home with the app on and wait for a ping, Pizzay delivey guys can not. Uber drivers can log on any time they want, pizza delivery guts can not.

Uber drivers drive people around for money just like a taxi driver.
