I just received an email from Uber stating a rider of mine claims I made him
pay cash up front and he was then also charged for the ride.

I emailed back stating I have never done this and could they be more specifics of the ride. Lo and behold it was a rider whose fare was $83 for a 15 mile-ish ride which was on a 3.something surge.

I did remember this ride because I rarely get surge rides and this was the largest I've ever had. I emailed them back describing the ride as they requested... let's see what happens so far the ride is still listed on my statement for $83.

Coincidently after the ride I emailed my daughter about it because it was large and I felt bad for this drunk kid and told her he was not going to be happy when he sobers up in the morning I guess I was right.

This is a clear case of extortion, on the passengers side. Don't let Uber bend you over on the fare, make sure you get this resolved, in your favor.
Please keep us posted as to the final outcome, it's important to see how Uber handles this, bogus issue.

Ask to have it escalated and once you get a real CSR and not just canned responses forward the time stamped email you sent your daughter. That should be pretty good evidence you did not take any cash.

I have received an update and apparently the CSR now says that the issue is that the rider who was charged is saying he did not take this ride and NOT that I requested cash upfront. So I told them what I could remember about the passenger. The ride and full fare is still listed in my earnings. So either this guys account was hacked or he has buyers remorse and is trying to get out of paying the fare. I'll update if I hear anything else.

I don't have a dash cam because NH is a two party state and I didn't want to have to ask permission to record the sound on every ride. But now I'm definitely reconsidering getting one now.

dash cam, dash cam, dash cam. Usually wiretapping law will get tossed out if it's proof to counter fraud. Of course, every situation and state is different.. seek your own legal advice and don't take my word for it. my audio is disabled right now because I too am in a 2 party consent state

Im mostly concerned with having proof that someone exited my vehicle safely and can't say that I hit or touched them, ya know? In your case, video without sound would be useless, obviously. It would prove that there wasn't a transfer of cash though.. which would probably be enough.

Im looking for the law but I read somewhere that one of the exceptions to the 2 party audio consent is where an intercept (recording) would be used to monitor the quality of service or something like that.

I'm searching... but 2 party consent states are tricky

i know it's a pain and I wouldn't want to do it and I don't but you could always start the trip by saying "to ensure the highest quality of service this trip will be electronically documented for insurance purposes" or whatever.

im not sure if an in-vehicle placard displaying to the rider about monitoring would be enough..

im going to look around...

If uber cared about driver safety it would be built into the TOS of the uber agreement.

Not sure but I think it is implied consent if you have stickers like mine conspicuously posted saying "WARNING video surveillance" and the rider accepts the ride. It works on public transit because the expectation of privacy is nullified in a publicly accessible conveyance...which is what an Uber car is. I would like to hear a debate on whether the stickers are even needed since it is, after all, a publicly accessible location where there can be no expectation of privacy ... like any other store that you walk into.

btw how is uber in gainesville?

Im looking for stickers now to place inside the car. Im thinking on the little triangle window on the rear windows.

Can't you just post a notice on the door? "VIDEO RECORDING IN PROGRESS" or something? how does the quicky mart or the bank run video in their branches?

2 party consent is only for audio

for video you don't have to do or say anything about it..

and yes as far as Ive learned from various sources online as long as you have it posted in plain view and the rider doesn't protest then it's implied consent

He's just trying to get out of it. The cash part was a dumb stunt to try and tell them he already paid for the ride, he didn't likely know this is a huge no-no for drivers and that he accidentally reported you for such a heinous offence. Stick to your guns and good luck.
