ok i was stopped by a policeman friday night, he says the light was red, i told him, forgive me but i think it was yellow and i have a a video camera and 2 dash cams that might prove otherwise, he looks in the car and says if that camera takes audio , i said i don't know, maybe it does , maybe it doesn't , but the regular camera does do audio, the policeman then says "as a courtesy, next time i get stopped by a policeman, i should let them know they are being recorded". then gives me a ticket for a "missing or non functioning rear light". he wanted me to sign it, i told him , i would never sign anything from you! i drive very carefully and the sure enough, when i left the area i sang "i shot the sheriff" gotta love people from the 70's like me! so i guess it is ok to even audio record the police and anything else because uber / lyft is considered a public vehicle in florida! can someone who is in law enforcement please explain to me audio recordings in florida for non public vehicles and public vehicles and what are my right when i get stopped by the police, i mean i have arrest bond protection but i think it is best not to use it! :D of course when i was stopped, i turn on the interior lights and put my hands on the outside roof of my van, through the car window, and turn off the van and had all my papers in hand already and had two flashlights on for extra light! is there anything else i could have done to make this officer feel safe? at 3:15 am i don't want any doubt in that policeman's mind as to how non threatening we are in my van!

1. Just curious, did you have a passenger with you?

2. Regarding the ticket, seems like he was offering you an "equipment violation" as a way out of the "moving violation" (running a red light). In some states, there also are violations for pushing yellow lights; don't know about FL.

3. Finally, be on the lookout. The officer still can process the ticket without your signature. MANY YEARS AGO, I had a similar incident and even saw the officer tear up some paper while returning to his car. I thought situation was resolved. Several months later, I received a summons to traffic court.

Take it into a court. Chances are that the neanderthal cop won't show up.if he doesn't than you have a lawsuit. Under the 6th amendment.if you do research you will find that your civil rights were violated. If the cop looked into your car than you have 4th amendment violations.

i would never ever say i had passengers in the car here! i have gotten emails from uber and lyft about hings i post here! so i won't be admiting anyhing ever here ok!

if i did have passengers they would have ok'd the video beforehand, and really that would benefit me , because they can always say the guy was driving like he was driving miss daisy, which i do!

i would really hate to go to traffic court, sort of like going to a mental hospital that your worse enemy is the doctor in charge! but i saw the video, the yellow light was very quick, like 1 and a half seconds at the most! a car traveling at 55 mph travels 110 feet/second during that time, which means if it changed at 220 then i would have enough time to stop, but i think the whole distance isn't 200 feet! if that! i can't get out of the rear light though, it was out and i didn't check before i started my shift, i was hurried by a regular passenger who called me up! i think a yellow light should be longer, in florida the yellow means stop if you can, unless they changed it since i took my cdl course for truck drivers.

excuse me but how can you stop a person from just looking into your car? and some states don't allow really dark windows! court will be an all day thing and still i have to fix the light, i drive nights! i mean it is easy to see the regular camera, the dash cams are very small, but you can see them if you look at them! are you a lawyer?

now a days everybody records nothing is private anymore!

I have notices above each door handle that says, "Security Notice: By entering you consent to being video and audio recorded.".


IANAL but my understanding of the laws are:

1) People outside of the vehicle who are in public or can be heard from a public place have no expectation of privacy and may be freely recorded.

2) On duty peace officers never have expectation of privacy and may thus always be recorded.

"Use" of what you record is an entirely different matter. Just because you may legally record something doesn't mean you may use it in various ways. That's beyond the scope of this discussion so I'm not going to derail the topic. But I'm pretty sure in your situation you had zero obligation to inform the officer you were recording. Depending on the cop it may or may not be in your favor to inform them. There are plenty of videos where they turn tail once they know they're recorded, as well as videos of them stealing/breaking recording equipment..

Wait, you got emailed by Uber and lfyt about things you say here. Wut?
yes i got an email saying that i have to obey local laws about recording passengers, and the only place that was ever discussed was here, either we have a snitch here or uber/lyft sees this blog

Or one of your passengers complained to Uber about illegal voice recording.

It's legal to record police officers while they are working. That's been challenged in the past. They may try to stop you and they may not like it, but it's legal. Has nothing to do with uber or Lyft.

After all, what expectation of privacy would a cop on the job have?

As far as tickets, signing it is just acknowledging you got it. Not signing just makes you seem like a dick.

I just put the interior lights on and my hands on the steering wheel. And usually my license is buried in my backpack, so I let them know I'll have to dig for it. Basically, no sudden moves and let them know what you're doing.

There's s good chance if you fix the light and show that it's fixed immediately you can get that ticket reduced/dismissed. It may not be worth the hassle though.

no lyft sent me an email saying i need to respect the laws about voice recordings

the only place i even discussed the possibility was here on this board!

now hypothetically speaking, if i was to buy a black sony voice recorder for $40 to $60 at walmart that records over 30 hours and can't been seen and was placed in the car, to record what was said , then i think hypothetically speaking that would be a very good thing. seeing that sometimes we take kids in the car and what if that child was to say you touched them , or some troubled teenage needed a ride and said you take me or i will you raped me or whatever! at least for $60 maybe even less,( prices go down while recording times go up right?) one would have a a audio witness of what went on in that car! the other day i took this couple from hines and columbus to what i thought was a drug buy, while the guy was outside, the girl says we should get into a "T bone" i thought she was talking about a T bone steak! but i asked her , what did she mean? she said a t bone car accident, i asked her did she get money, she said yes, she got $10,000 for that one time! i asked her if she had more than one, then the boyfriend got in, and when i mentioned he conversation with her, he got all mad and said don't ever mention anything with bone in it ! and he kept on ranting and raving about how messed up i am! i apologized and then left him and the accident queen at what at first looked like offices behind the 7-11 at himes and columbus, obviously the guy already had in his mind everybody was trying to pick up his woman and couldn't be persuaded that she wanted me to get into a rigged car accident to get $10,000. that whole situation could have gone really bad ok! had i been a little more tired, had i used my testosterone medication, had he try to touch me! who knows, but hypothetically speaking, with a voice recording, the police could have heard why i had to kill him and the woman! :p might have been justifiable homicide

again! :p

hypothetically speaking i think you are very ignorant, and qualify to be one of my relatives if you don't have a black little $60 or less, sony voice recorder and at least one dash cam, or at least a regular front facing camera

i will do the notices, that is a great idea
i will still ask for permission before i post anything to youtube again!

usually i tell my passengers i am video recording and if they want i can post it to youtube and if they want i won't post it and the video will just be eventually recorder over. i have a regular camera in front unless the person is blind, they can see it anyway. i explain to them the reason why i have it is for accidents, this way my kids can see the video and say "see dad was driving well, and there goes the truck that ran into his car and killed him and his passengers"! that usually gets a laugh out of the people! the really sick minds like mine, laugh hysterically at that one!

To the OP you should have no said anything and went home and reviewed the tape, if you were still yellow you bring the recording into court with you as proof you didn't run the light. Bonus points if you wait until AFTER he tells the court you ran a red light.

yes it was a quick yellow, 1.5 seconds and yes it was yellow,

i don't wanna stand my ground, i rather sit on my couch typing stories on this site! for me to stand my ground means i have a gun or weapon, which even though i am alone with sometimes up to six people angry because i didn't allow seven... and they waited 20 minutes for me to show up....i won't say i have a 38 in an ankle holster on me...nah me knowing there are snitches here or uber/lyft watch this site.....i would never say i have anything to defend myself ;) i am a peaceful man, hypothetically speaking i don't blame night drivers who want to defend themselves against those who see us as easy targets. just like that poor soul they took on a crime spree for 9 hours! when i worked in united cab several drivers had guns

Florida is a two party consent state.

"Florida makes it a crime to intercept or record a "wire, oral, or electronic communication" in Florida, unless all parties to the communication consent. See Fla. Stat. ch. 934.03. Florida law makes an exception for in-person communications when the parties do not have a reasonable expectation of privacy in the conversation, such as when they are engaged in conversation in a public place where they might reasonably be overheard. It is absolutely not okay to record audio in public or private without consent. I'd you'd have said yes, it records audio you could have been arrested. I doubt you would have but...
Nonsense. Inadvertently recording something which happens on the exterior of your vehicle while out driving on public roads is not illegal.
