Pick-ups with babies

I have had several ladies get in to my Uber car with babies, and they intend to just hold the baby in their arms for the ride, no car seat. I have refused them every time, and every time they get very angry, and they say that other Uber drivers allow this. Do you?

I never intend to get into an accident, but it's Chicago, it can happen at any time, and when it happens, even a mother's arms won't be enough. Not to mention, if you are riding this way and get pulled over by the police, the ticket is going to YOU. I believe the law is: a child under 40lbs. must have a car seat or booster. Or no ride.

Under age of 8 ... All of them have to have special sit. If they don't it is illigal... Plus think if lawsuits parents will take u to ... And they will ones the see that medical bill...

Get a car seat, try the SA or Goodwill, it doesn't have to be new just compliant. I had a fare last week, nice folks, decent fare-they tipped-the last stop they picked up the little girl, 4 possibly but very small. Nice kid, didn't want to put out the pax so I let her sit in the middle wearing the seat belt. And of course we saw at least one cop before-just before-I dropped them off. That would have been my ticket, btw. Problem I have now is that with a car seat in the trunk I can't carry as much luggage in the car. Next time hopefully the child will be with the pax at the initial pick up and I can refuse for obvious reasons. The standard in Michigan is either younger than 8 or smaller than 4'9" requires either a booster or child seat, the baby the other day needed the child seat.

Uber of course says nothing about babies or toddlers, Uber leaves that problem to the diver and the riders to figure out. I picked up a nice couple with a toddler and they asked me about a car seat.. I don't have one... They took the ride and I accepted the fare but in hind sight I will now be rejecting all toddler and baby rides. I'm not getting a car seat, these parents will need to figure it out, I'm just cancelling the ride.

Be very careful. I looked up the law and although unlikely you may not just be ticketed, but arrested as well (2nd offense is a felony). Most likely the cop will go after the parents but legally in Illinois it is the drivers responsibility. My experience is Uber has your back if you refuse the ride and report serious rider concern.

To the best of my knowledge there is currently no regulations on Uber / Lyft . Commercial vehicles (which would include a Taxi) are excluded from the Child restraint act however, Uber/Lyft is not considered a commercial vehicle under Illinois law as of now.

So, in short, the child is required to be in a child seat in Uber/Lyft and under Illinois law the parent or legal guardian is responsible for providing the seat.

(625 ILCS 25/4) (from Ch. 95 1/2, par. 1104)
Sec. 4. When any person is transporting a child in this State under the age of 8 years in a non‑commercial motor vehicle of the first division, a motor vehicle of the second division with a gross vehicle weight rating of 9,000 pounds or less, or a recreational vehicle on the roadways, streets or highways of this State, such person shall be responsible for providing for the protection of such child by properly securing him or her in an appropriate child restraint system. The parent or legal guardian of a child under the age of 8 years shall provide a child restraint system to any person who transports his or her child. Any person who transports the child of another shall not be in violation of this Section unless a child restraint system was provided by the parent or legal guardian but not used to transport the child.

I have finally had enough of this and printed out a couple copies for the Secretary or State (cyberdrive something or other) website. A few weeks ago, one angry father slammed the door so hard I thought he was going to break the window when I refused his 4-5 year old and no booster seat. It is quite clear what is required and what the child should "look" like with a seat belt on and if that isn't what the kid looks like, they need a booster or car seat or whatever.
