Picked up pax in busy bar area. Gf got in back seat and when dude was getting in front seat he swung the door open so wide that he smashed the taillight on a parked vehicle. Cops standing 20 feet in feont of me witnessed the whole thing. No damage at all to my car, but i had to send 3 sets of pictures to UBER for them to reactivate my account. James River will pay fir the damage im sure but it aeems to me the negligent pax should have to reimburse them for being a total idiot

No. They are 100% responsible. If there was damage to my car it would be the $1000 deductable but not so much as a scratch on mine. Metal beats plastic every time
Ok that's great to know that 3rd Party Liability Damage does not have a deductible. I know it's spelled out with Uber, but it's good to hear it confirmed by a Driver.

It is a great thing for you that the cops were watching when it happened and could back up your statement. But I'm also kind of surprised they didn't find you at fault for parking too close or something. Knowing my luck they'd still probably find some way to charge me with an offense if my pax did that.

No. They knew i was in a tight area with tons of pedestrian and mayhem all around and there was no need for him to swing the door like he did. It wasnt intentional but it was 100% careless on his part. There was plenty of room for him to get in

$1,000.00 deductible.
What kind of car ?
New tail light installed could be $250.00 - $500.00
Tail lights aren't supposed to break that easy !

Not sure if the OP had this issue fully resolved and knows for a fact that JR isn't going to charge him a deductible, but he is correct.

According to Uber's policy, Liability coverage does not include a deductible. Uber knows that'd be a lawsuit ready to happen if they don't cover 3rd party damages. The deductible is only for the Contingent Collision and Comprehensive coverage, so if the driver doesn't want to pay the deductible, they don't get their car fixed.

Not Uber's problem, there will be another driver to replace you.

I talked to the guy at James River and I am not responsible for any deductibles etc. I still say the moron pax should have to pay it but as long as it doesnt come out of my pocket i dont really care

Yea I agree, it's possible that they may go after the pax, but who knows.

What sucks is if they did do enough damage to your vehicle to require repair, which would fall under the contingent comprehensive with the deductible. Although I'm sure you could take the pax to small claims court... in such cases I would make sure the police are called so they can get verified contact information from everyone involved so you can sue if needed.
