From Community Guidelines Rider Terms of Service
Respect each other
Treat your fellow riders and drivers as you would like to be treated yourself: with respect. Always try to be on time for your ride because nobody likes to wait. It's common courtesy not to shout, swear or slam the car door. And by tidying up after yourself - whether it's taking your trash home or cleaning up a spilled drink - you'll keep the car in good condition and ensure the next person has a pleasant ride, too.
Children must be supervised
Only adults can have an Uber rider account. If your child is using your account, a parent or guardian must be with them at all times.
Terms of Use
As a rider, you agree to our Terms of Use when you sign up for your account. We may take action against you for violating these terms, including permanently closing your account. For example the failure to maintain accurate, complete, and up-to-date account information, including having an invalid or expired payment method on file; allowing a person who does not meet the minimum age requirement to use your account while unaccompanied, or if you don't meet that age requirement yourself.
Signing up as a minor
In order to use the Uber rider app to request a ride, you must be 18 years of age or older.
Access and Use of the Services
User Accounts.
In order to use most aspects of the Services, you must register for and maintain an active personal user Services account ("Account"). You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18), to obtain an Account, unless a specific Service permits otherwise. Account registration requires you to submit to Uber certain personal information, such as your name, address, mobile phone number and age, as well as at least one valid payment method supported by Uber. You agree to maintain accurate, complete, and up-to-date information in your Account. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access or use the Services. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times. Unless otherwise permitted by Uber in writing, you may only possess one Account.
User Requirements and Conduct.
The Service is not available for use by persons under the age of 18. You may not authorize third parties to use your Account, and you may not allow persons under the age of 18 to receive transportation or logistics services from Third Party Providers unless they are accompanied by you. You may not assign or otherwise transfer your Account to any other person or entity. You agree to comply with all applicable laws when accessing or using the Services, and you may only access or use the Services for lawful purposes (e.g., no transport of unlawful or hazardous materials). You may not in your access or use of the Services cause nuisance, annoyance, inconvenience, or property damage, whether to the Third Party Provider or any other party. In certain instances you may be asked to provide proof of identity or other method of identity verification to access or use the Services, and you agree that you may be denied access to or use of the Services if you refuse to provide proof of identity or other method of identity verification.
Car Seats
We expect riders and drivers to follow local rules and regulations regarding infants and small children. Riders are welcome to bring a car seat with them to install and use in the Uber. However, if you do not feel comfortable transporting children, with or without a car seat, it is up to you whether to accept the ride.
State Car Seat Laws for the US
Each state regulates car seat compliance. Please look into your local state laws regarding transportation of children under the age of 8 years of age. It is at the drivers discretion according to Uber and Lyft to accept passengers without the proper car seats, but it is on the driver regarding liabilities and violation of local laws.
The platforms rather than inform potential passengers, place this responsibility back upon the driver (partner) to enforce.
As a driver DO NOT place yourself in a position of breaking Local, State, and Federal laws in this regard.
Included is a select overview of some of the states laws in this regard. Please look into your states laws!
New York
Updated in 2009, New York law states that children must ride in an appropriate car seat or booster seat until they reach their 8th birthday. Children under age four should be properly secured in a child restraint that is secured to the vehicle with a seat belt or LATCH system. Children under age 16 are required to wear a seatbelt. The state further recommends but does not require, that children remain in a booster seat until they reach 4'9" or 100 lbs and can sit in the adult seat belt properly.
You can be pulled over and get a ticket for seatbelt or car seat violations.
California
According to California State Law, children must be seated in the rear seat of a vehicle in an appropriate car seat or booster seat until they are 8 years old or 4'9″ tall. Children must remain in a rear facing car seat until they weigh 40 pounds or more or are at least 40 inches tall.
All passengers of all ages are subject to California's Mandatory Seat Belt law.
Illinois
Illinois Child Passenger Protection Act
The Child Passenger Protection Act requires that all children under age 8 be properly secured in an appropriate child safety restraint system. This includes the use of booster seats, which must only be used with a lap/shoulder safety belt. If the back seat of the vehicle is not equipped with lap/shoulder type safety belts, a child weighing more than 40 pounds may be transported in the back seat without a booster seat, secured with a lap belt only.
Endangering the Life or Health of a Child ; It is unlawful for any person to willfully cause or permit the life or health of a child under the age of 18 to be endangered or to willfully cause or permit a child to be placed in circumstances that endanger the child's life or health.
A violation that causes the death of the child is a Class 3 felony for which a person, if sentenced to prison, shall be sentenced to a term of two years and up to 10 years.
