I suspect there will be one less Uber Black/SUV driver. I base that on the assertion that the driver actually cancelled and requested the new ride with the passengers phone. Apparently, either the driver couldn't do the math or he knew the rate would still be in the sky and lied about it.
 
The driver did him a favor. He obviously wasn't good with math, but the fare would have been higher if he hasn't cancelled and booked at the lower surge rate. Another dick customer trying to get a free ride. Yes its high, but he agreed.
 
Waaa. What would a taxi have charged? And when would it have been available? They push this off like it's the driver's fault. Uber has the pricing control, not the driver. Just another case of Uber throwing the driver under the proverbial bus.
 
The driver did them a favor, picked up a group in his SUV, let them cancel and rerequest BLACK at both a lower per mile rate and a lower multiplier.

On both ends he had to accept the surge notification and agree to it.

Maybe the driver was a little daft in saying he could make a $150-180 fare into a $120 one.

He did technically, but he couldn't help them with the multiplier.

I say no refund.
 
If you can't afford UberBLACK on surge, you need to stick with the UberX product.

The alternative is a Lyft, Taxi, public transportation or walk.

The only way I can see those passengers getting from Culver City to El Monte for $45 is on UberX. UberXL would probably have cost them closer to $70.

Considering the time it happened, they probably were drunk and ordered the wrong service.

Who really knows if their story about the driver using their phone to cancel the original ride and request a new ride is true or not. I doubt Uber will refund. They could sue the driver, but unless they can somehow prove the driver told them it would be $150-200, or used their phone to rerequest the 2nd ride (I'm sure he'll deny it), they probably are stuck.

My gut feeling is they were drunk, ordered the wrong service, were oblivious to the price until the driver got there, complained to the driver, reordered the UberBlack, said screw it to the the new price (prob because they didn't want to wait for an UberX, and because they were still drunk) and got home and passed out. Next day, after sobering up, they saw their bill and said oh crap.
