I'm looking for help or some advice. I had a disagreement about politics with a rider and he decided to report to Lyft that "I seemed like I might be under the influence". They won't tell me who made the report so I don't know for sure.

Now after a consistent 4.8 rating and over 400 rides Lyft just instantly deactivated my account and is not responding to requests. And on a side note, I'd never drink and drive a PAX! That's why they take Lyft in the first place. So they can have a good time and remain in safe hands. Also I'm in Arizona of all states which is a 0 tolerance state.

For the love of god. Can you just have any driver's account you don't like deactivated with no evidence at all? Oh hey I don't like his personality, I'll take away his income! What should my next move be? I can NOT let this stand.

Advice? Thoughts?

It's called pax is always right. Most legit places will have a disciplinary hearing or something to that affect. But being a TNC driver, you're only a number. And an easily replaceable one at that.

First, I would look at the Lyft agreement. I don't have it in front of me but my guess is that they can terminate for any reason, or no reason. Suing lift means that you are going up against a deep pocket company with gobs of lawyers and a document written to their maximum advantage.

If you want to sue the passenger, you need a lawyer to prepare a case, review your documents, file your papers, etc. This is not something that an attorney will do on contingency - I.e. You will be paying an hourly rate for services. Average rate in PHX is $255 per hour and this would be many hours of work.

I recommend trying to solve it in person by talking with the market manager. I'm not sure if you are in Phx or LV, but there must be an office somewhere. Maybe another poster has the address.

Also, don't talk politics with pax. Nothing good will ever come of it.

Some girl said I inappropriately touched her - was deactivated for 1 week, and then reactivated on further review. It takes some time for them to review the case. It just goes to show how powerful pax are when it comes to incidents. Its deactivate first - ask questions later.

Yeah, they can act with impunity in your car just because they are paying you a few bucks. I was deactivated for three days just because some pax said something. A lot of problems would be avoided if pax would simply sit in the rear seat.

I'll be the first one to say invest in a $25 - $50 dash cam. I use mine to prevent any allegations against my driving and behavior. Even though no one mentioned it I can only hope a few of you have a dashcam or your asking for a setup. The quickest method to Lyft is through Twitter, yes its dumb but I always get a respond within an hour as oppose to hours or days via the alternative method. Good Luck with this case.

I doubt you have standing. On the other hand, find other "wrongly" deactivated drivers, and you'll find plenty of lawyers who will work for a piece of the action
Heads up, doormat. By your picture I would think you would take no sh***. Maybe you are saying he should handle it some other way?

There is nothing wrong with suing someone who has wronged you in order to make it right and deter people from doing it to others. He was the one who lost income because of the slander so he obviously has standing. You or I would not have standing to sue because the person did not slander us. I am not sure what you are trying to say.

He may have a hard time proving he was not drunk or the pax had a reasonable belief he was drunk. Maybe he does not want to take the time and trouble, but he certainly has reason to sue. This pax took away his livelihood, and on top of that the court needs to punish him with punitive damages because he did it intentionally.

Name calling? I'll ignore that.

You made good points, but left out the part about Lyft having contract language that says they can deactivate for any reason they choose. Thus, probably no standing.

I do happen to agree though. They have no business deactivating someone based on a passenger making an unsubstantiated claim.

I didn't expect you to kick my a*** if you think the OP should let people walk all over him. I am just giving you a hard time, actually. But I don't see anything wrong with suing someone doing that to other people.

Lyft can deactivate for any reason, but they deactivated because of the pax claim. He has a claim against the pax and would have standing because he was the one defamed.

You are right, he probably has no claim against Lyft, but he does have standing to sue and lose if he wants. Most likely his case would lose/ get his case dismissed just because he has no real case against Lyft, not because he does not have standing. The word you are using is what is confusing.

Who wouldn't deactivate if they got a report that one of their drivers was drunk? That is a very serious allegation. Lyft would get sued by others if they got a report he was drunk, left him driving, and he piled it up. We haven't heard from him so maybe Lyft did investigate and reinstate him.

This gets into the weeds, and I'm no lawyer. There's possible defamation. But, Lyft is the deep pockets, so it doesn't seem fruitful to chase the defamer.

Basically, these TNCs are wretched, and they're serving equally despicable customers.
