I see it coming. Someone hails a taxi from the street at a busy time. Passenger says "I'm only going down the street. Driver says "it's $20. If uber can do surge pricing so can we". I don't think the taxi driver has to go by any established meter rate if it's street pickup.He or she can charge a flat rate of ny price if it's agreed upon before the passenger enters the vehicle.

This has always been the case. If a ride is solicited on the street, than any price could be negotiated. If you call a ride from a dispatch service or app, you are only obligated to pay the quoted rate. Outside of that, any price can be asked for, however unless agreed upon its not legally enforceable unless displayed on a taximeter or app.
