What the restaurants are doing is against a Supreme Court ruling, and IRS definition, of what an independent contractor is. There are three criteria to establish whether or not an individual is a contractor, and by telling you to start the trip before receiving order is a violation of the section under "control". They are imposing "their" control over how you conduct your business. If it wasn't a violation then all delivery apps would've notified every restaurant partner to do just that. They didn't, because they know it's illegal. Unfortunately the restaurants don't know that. And for the record of "who's stealing what", no one finds it a bit odd that most, if not all, orders that have been "stolen" are from fast food places(McDonald's, Taco Bell, etc.) and/or were from low/no tip customers? Seriously, why on earth would a driver not wait for a steak house order to pull that crap. As far as the pre confirmed thing, it doesn't require any real effort to do this, but it does violate your rights as a private business owner(independent contractor). Every time we turn a blind eye to little things, like this, and continue to allow them to happen is why our voices are never heard on other subjects. Driver's, restaurants, gig platforms all need to be on the same page with the rights of independent contractors. The restaurants that have to remake orders, take a tax deduction on the cost of those orders... it's called "waste". So don't go sympathizing too much with them
