I have a dash cam we use while traveling with our fifth wheel. I have been reluctant to use it while uber'ing/lyft'ing because of second party consent laws in Washington state as well as frequent trips onto the navy base (prohibited... if the gate guard notices). Is second party consent really required if you didn't share the recording with anyone other than law enforcement?

On the military base they definitely will tell you not to film, but they may just require you to throw a towel over the camera and leave it there. Many uber/ Lyft drivers go on base and many have dash cams. I used to drive a semi truck on and off JBLM with a company mounted dash cam and all the guards told me to do was cover it with something. I threw my coat over it and they were happy.

As a military retiree a frequent the base and only once since I bought my dash cam two years ago have the guards even noticed it while driving my POV. (I turned it off... they said ok good enough and waved me through).
I feel fortunate in that 80% of my riders are active duty, my concern lies with the other 20%. If I have a dash cam or audio recording device do I need to disclose this to the rider if I have no intention to share it with anyone other than law enforcement?
I have not used my dash cam since I started driving TNC 4 months ago for fear of violating privacy laws.

I have a dash cam that records video out and audio inside. I wouldn't even consider driving without it.

The camera recently paid for itself when an Uber driver hit my vehicle. A third-party witness gave false information to the police after the accident. The key is to not tell anyone you have the camera. Let them sink themselves. Then produce the video that discredits their testimony.

I'll do a montage of the things I have seen.

99% of pax are too self-absorbed to even notice it. I don't have any notice posted.

As for the audio component, I would simply erase all audio prior to releasing to anyone. If someone other then me is pulling the memory card from my dash cam, then something has gone so bad that two-party consent will be the least of my worries.

Well you make good sense. I guess if you got into a position where audio was an issue you should have an attorney involved anyway. I live and drive in a rural area with great riders but i am always concerned with the the threat of crazies! Thanks again for the solid advice.

Mine has saved me twice. Once from a passenger who was drunk at 0715 and would not get out of my car, and again when I got in a fender-bender that was not my fault. Cops believe what they see with their own eyes and hear with their own ears. Mine takes video and audio inside and video outside.

I think it's helpful, we are a two party consent state so if you tried to sue someone they could file a motion to have the dash cam suppressed as evidence but most people will back off you knowing you have a record of what really happened.

A simple "this is for both our protection" sign is fine IMO.

Saw someone kinda like that in Belltown last week. Drunken/fried crazy guy walk accross the street illegally in front of large suv. Slammed on brakes and had to swerve. Dude didn't even look or care that cars were driving and he was mid block. He literally yelled all the way down the block throwing his arms around wildly.
