Hi there fellow drivers. I am searching for help in what to do in my situation. I had someone crashed into my car and fully damaged quite badly both passanger doors. It was on 12 december 2022 and person at fault lodged a claim with aami same day. The problem is smash repair is busy and I only could book my car for damage inspection for today 23/01/23. Today I got there and they inspected and said they still very busy and can only fix it in 15/05. All that means I was not able to drive for uber for all this time, more than 5 months 🙃. Any suggesrions in what best to do in this situation? Thanks a lot everyone, cheers….

at fault drivers insurance is liable for your lost wages as long as they write that your car is an Uber in the original claim. Only other option is take take at fault driver to small claims court but i don’t like your chances of proving 5mths lost wages

I've done exactly that before.

The nice forensic accountants at NRMA will need your BAS as historic proof of income. Then they take off tax and every cent they can justify. Good luck. Insurance Companies don't make things easy - they don't like to let you know what you can claim. When you do try to claim, you have to jump through hoops.

Hopefully you had a bumper December quarter and get every dollar you can from them. Given its quiet, I would not be returning to work in a hire car either - sit back and let them pay for the delays.

Any issues, contact this mob. The insurance company will know you mean business.

Sorry to hear about the accident! I'll weigh in here:

First, you can try to open a claim with the at-daily driver’s insurance and tell them that the wage loss is a direct result of the property damage. You should provide three months of wage statements to show your average monthly wages. Multiply that out by the number of weeks or months that you're off work.

In the meantime, it is advised that you find another vehicle to use, even if there’s a rental fee involved. It is better to mitigate damages and work, as opposed to taking the full time off and trying to clean all of that lost income. Insurance companies are sometimes more willing to pay a portion of the lost wages, if you show that you took an effort to mitigate damages.

All these not at fault accidents likely to give you nothing. There are many things that can go wrong.

The at fault party flees and won't pay, insurance won't sue to recover due to hassle, police is too slow to give address of the party to insurance company, insurance/owner happy with excess.

Imagine the length of work insurance should go to recover $2000 from someone. They need to chase them with police and follow up. Police can attempt the address many times and not find the respondent. If the at fault party don't respond, they need to lodge court claim. In court they may not appear. If they show up they have all kind of excuses for not being able to pay $2000 upfront because they are renting car and doing hours work to feed family blah blah.

Eventually they may agree to pay $200 a week but then again dodge payments. Most insurance companies have quitted by then and accepted the loss. Especially, if the not at fault driver has already paid an excess. Because if they have the excess already, it means they have recovered some % of the loss. If they sue the at fault party they need to pay excess back to the not at fault party.

Excess and insurance premium are part of a whole ring of scam run by insurance/rental companies.

My rental car was hit by an at-fault car. I paid $1000 excess and saw none of it back. It's been 1 year. Insurance says they are attempting recovery and if recovery done they will pay excess back.

Best solution? Use your own $7k car to work for Uber.

That’s helpful. Now Jared, how do you propose to represent a client in Australia given you are based in the States? I hope you pay a little more attention to detail when representing your clients.

at scene of accident simply tell them to write down they hit an Uber & bingo you get lost wages. If their not insured then your insurance will pay lost wages. Simple

Valid points.

The guy that hit my car wrote it off. He closed a major road for 7 hours. Unfortunately, the jaws of life cut his car open and he lived.

For that, he was under policy guard while in hospital. So no chance to do a runner.

Can't speak to the regular process with insurance companies if someone does a runner. 👍
